Terms and Conditions For All Aboard the Heritage Express

1 Event
The “All Aboard the Heritage Express” event (“the Game”, “the Event”, or “the Campaign”), is organised by Strides Engineering Pte Ltd. (“Strides”). The event commences on 5 August 2024 09:00 (UTC+08:00) and closes on 31 August 2024 23:59 (UTC+08:00).
There is no participation fee for joining the event. The participant(s) (the “Participant(s)”) agrees that any costs incurred while participating in the Event is solely to be borne by the Participant.
Communications in relation to the event will only be distributed through Strides’s official communication channels. Strides retains the discretion to disqualify any Participant without any prior notice from the event if the Participant is found to be monetising the in-game items as distributed through Strides’s official communication channels, including within the Game.
By participating in the Event, the Participant warrants and represents that the Participant has attained the age of 18 years or, if under the age of 18 years, has the Participant’s parent or legal guardian’s consent to enter the Event and agreement to all terms in these Terms and Conditions (the “T&Cs”).
By participating in the Event, the Participant agrees to conduct himself or herself in an appropriate manner throughout the Event and agrees not to obstruct, injure, or otherwise harass fellow Participants and Strides’s representatives and/or employees.
By participating in the Event, the Participant agrees to strictly abide by and comply with the safety instructions as issued by Strides. The Participant agrees that, apart from the safety instructions issued by Strides, the Participant will take reasonable precautions and safety measures while participating in the Event.
2 Eligibility
The Participant must not be an existing employee of Strides, or each of their Affiliates or contractors, who has been directly involved in the conceptualisation, development and execution of the Event (“such person”), or (ii) an immediate family member of such person. “Affiliate(s)” means an entity controlling, controlled by, or under common control of a party.
3 Licence
Each Participant agrees to grant Strides and/or its Affiliate(s) a perpetual (regardless of whether the Campaign has ended), irrevocable, non-exclusive, royalty-free and freely transferable licence to (without prior notice to the Participant) publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute the Participant’s works, such as but not limited to Instagram Stories, Telegram stickers, for the promotion and publicity of Strides and/or its Affiliate(s); in any manner, format, or media known or later devised, in perpetuity, including and without limitation to online platforms such as Facebook, Twitter, Instagram.
Each Participant also agrees to grant Strides and/or its Affiliate(s) the right to sublicense the rights licensed above without prior notice to the Participant.
For the avoidance of doubt, Strides and/or its Affiliate(s) expressly reserve the right to adapt, edit, or modify the above-mentioned works for any promotional or marketing purposes of Strides and/or its Affiliate(s) without prior notice to the Participant.
The Participant warrants that the materials, achievements or works provided by him/her in this event are independently created, comply with all applicable laws and regulations, and shall not infringe any copyright or other rights of any third party. Should there be any violation, the Participant shall be fully responsible for resolving and indemnifying Strides and/or its Affiliate(s) for any and all damages and expenses (including but not limited to legal fees and litigation costs) incurred by Strides and/or its Affiliate(s).
4 Details of the Game
The objective of the Campaign is for Participants to check in at predesignated locations via the Wink+ App (a mobile application developed by SMRT Experience Pte Ltd and available for download from the App Store and/or the Google Play Store (the “Wink+ App”)) by travelling around Singapore on the SMRT trains, buses and/or other transport services provided by SMRT, as the case may be (collectively the “SMRT Network”), as the preferred mode of transportation. Only Participants who have successfully checked in at all predesignated locations will be eligible for the Completion Prize (as defined below) (“Eligible Participants”).
Eligible Participant(s) may double their chances of winning the Lucky Draw Prize (as defined below) by completing a survey to qualify for a lucky draw.
5 Prize
Completion Prize: Eligible Participant(s) will be entitled to a Completion Prize (the “Completion Prize”) consisting of 135 WINK+ Points. The Completion Prize and its corresponding terms and conditions are listed in Annex A.
Lucky Draw: There will be a total of three (3) Lucky Draw Prizes (as defined below) given in the following order: 50,000 WINK+ points for the 1st prize, 25,000 WINK+ points for the 2nd prize, and 10,000 WINK+ points for the 3rd prize (collectively, the “Lucky Draw Prizes”). The Lucky Draw will be conducted within two (2) week from the end of the campaign using Strides and/or its Affiliate(s)’s proprietary developed algorithm, and the Lucky Draw Prizes will be awarded to three (3) randomly selected Eligible Participants (“Lucky Draw Winners”). Lucky Draw Winners will be informed of the results of the Lucky Draw via their registered email address on their Wink+ App. Any and all decisions made by Strides as to the selection of the Lucky Draw Winner(s) shall be final, and Strides reserves the right to modify and/or withdraw the Lucky Draw Prize(s) at any time at its sole discretion, and as updated from time to time in this T&Cs. The Lucky Draw Prize and their corresponding terms and conditions are listed in Annex A.
Each Eligible Participant may redeem a maximum of one (1) Completion Prize and one (1) Lucky Draw Prize per Campaign.
All Completion Prizes and Lucky Draw Prizes will be credited into the respective Eligible Participants’ and/or Lucky Draw Winners’ Wink+ App account within two (2) weeks from the end of the Campaign. Eligible Participants must verify that the Completion Prize and/or Lucky Draw Prize have been credited to their Wink+ App account and report any missing WINK+ points within four (4) weeks from the end of the Campaign. Failure to do so will result in forfeiture of the Completion Prize and/or Lucky Draw Prize, and Strides and/or its Affiliate(s) will not entertain any requests for any correction thereafter.
By participating in the Campaign, each Participant expressly consents to Strides’ processing, collection, usage and disclosure of his or her personal data for the purpose of Completion Prize and/or Lucky Draw Prize fulfilment, including sharing of such personal data with other third parties. Personal data is defined as the Participant’s name, email address, mobile phone number, date of birth, gender, travel card CANID and any other personal information that the Participant provides to Strides.
The Winners agree to have their name, WINK+ ID and/or photo published on, including and without limitation to, Strides’ and/or its Affiliate’s event website and on Strides’ and/or its Affiliate’s Facebook, Twitter, Telegram, Instagram, and any other social media accounts.
If Strides discovers that a Participant had, among other things, not conducted him or herself in an appropriate manner in the course of playing the game, or in a manner that is clearly prejudicial to the spirit of the Campaign, that Participant will not be entitled to the Completion Prize and/or the Lucky Draw Prize. In the event that the infringing Participant had redeemed the Completion Prize and/or Lucky Draw Prize prior to Strides’ discovery of their breach, Strides shall retain the right to demand that such Completion Prize and/or Lucky Draw Prize be immediately returned to Strides by the infringing Participant.
The decisions made by Strides regarding facts connected with the Event, including the result of the Lucky Draw Winners, are final. No appeals by the Participants will be entertained.
All Eligible Participants shall be responsible for all costs associated with collecting/returning the Completion Prize(s) and/or Lucky Draw Prize(s). Strides shall not be responsible for any costs associated with the above.
6 Data Privacy, Collection, Usage, and Disclosure
By participating in the Event, the Participant expressly consents to Strides’ processing, collection, usage and disclosure of his or her personal data for purposes of Participant identification, verification, validation, Completion Prize and/or Lucky Draw Prize fulfilment, contacting the Participant, diagnostic testing, fraud prevention measures, liaison and marketing. Personal data is defined as the Participant’s name, email address, , mobile phone number, date of birth, gender, travel card CANID and any other personal information that the Participant provides to Strides.
By participating in the Event, the Participant expressly authorises and consents to Strides’ usage of the Participant’s name, email address, date of birth, and mobile phone number, gender and travel card CANID for the specific purpose of referencing to its database to determine the Participant’s identity and eligibility.
The Participant hereby grants his or her consent to Strides to use his or her personal data provided for verification, contact, liaison, and/or marketing purposes in connection with any of Strides’ programmes, outreach, initiatives, and/or activities.
The Participant understands that the personal data will be processed by Strides and each of their Affiliates, partners, employees, directors, officers, agents, contractors, subcontractors, and/or assignees and any other person expressly authorised to process the personal data.
7 Liabilities
All Participants in the event agree that Strides and each of their Affiliates, partners, employees, directors, officers, agents, contractors, subcontractors, and/or assignees shall not be liable in any way for any and all claims by any Participant or third party, and agree to indemnify Strides and each of their Affiliates, partners, employees, directors, officers, agents, contractors, subcontractors and/or assignees against any and all claims made against Strides and each of their Affiliates, partners, employees, directors, officers, agents, contractors, subcontractors and/or assignees, including but not limited to:
a. Slander, libel, defamation, violation of rights of privacy, publicity, and/or civil rights, depiction in a false light, intentional or negligent, infliction of emotional distress, copyright infringement, and/or any other tort and damages arising from or in any other way related to their participation in the event;
b. All injuries, losses or damages to property or person of any kind, including death, claims, actions, proceedings and other liability arising out of or caused in whole or in part, directly or indirectly, by the acceptance, possession, use or misuse of the Prizes or participation in the event;
c. Any loss, late, mechanically duplicated, illegible, incomplete, mutilated, tampered, damaged, corrupted or misdirected entries; and
d. Any losses, costs, expenses, fees or damages incurred by a third party arising out of or in connection with the Participant’s involvement in the Event or any activity related thereto, including without limitation, any breakdown or malfunction of any computer system or equipment.
8 Warranties and Severability
Strides make no warranty, whether expressly or impliedly, that the event will be error-free and/or uninterrupted, and/or that the content or any functions associated with the Wink+ App will be uninterrupted or error-free, or that the Wink+ App is free of any viruses and/or other harmful elements.
Strides make no warranty, whether expressly or impliedly, as to any harm arising from accessing any information or material through the Wink+ App and/or Strides’ and/or Affiliate’s websites or social media platforms, including and without limitation to harm caused by viruses or similar contamination or destructive features, whether or not known.
Strides does not warrant that any clarifications or any other communication given with reference or in relation to the event will be error-free and/or uninterrupted.
Strides does not warrant that their safety regulations are the only safety guidelines that the Participants have to abide by.
Strides makes no warranty, whether expressly or impliedly, as to any harm arising from accessing any information or material through the Wink+ App and/or Strides’ and/or its Affiliate(s)’s official websites or its social media platforms, including and without limitation to harm caused by viruses or similar contamination or destructive features, whether or not known.
If any term or provision of the T&Cs is held to be illegal or unenforceable, such term or provision shall be deemed to be deleted from the T&Cs and the validity or enforceability of the remainder of the T&Cs shall remain in full force and effect. Strides’ and/or its Affiliate(s) failure to enforce at any time the provisions of the T&Cs or any rights in respect thereto shall in no way be considered to be a waiver of such provisions, rights, or elections or in any way affect the validity of the T&Cs.
9 Notice
The decision of Strides on all matters pertaining to the Event (including any dispute arising from gameplay, or any information transmitted by Strides in relation to the event, or interpretation of the T&Cs) is final and binding on all parties.
The Participant hereby agrees and acknowledges that all electronic communications made pursuant to the participation in the event shall be given legal effect, validity, and enforceability and shall have, between the parties thereto, comparable evidential value to that accorded to a signed written document.
10 General Provisions
Strides reserve the right to amend this T&Cs without prior/further notice. The revised T&Cs shall apply to the event from the date of publication of the revised T&Cs on the event website, and the Participant hereby waives any right that the Participant may otherwise have to be notified of, or to consent to, revisions of the T&Cs.
Strides reserve the right at their sole discretion, to suspend, postpone or terminate the Event or shorten or extend the duration of the Event and/or amend, modify, delete, supplement, replace or revise the T&Cs, without any liability or prior/further notification to any person, including but not limited to any Participant.
Strides shall not be liable to any party whatsoever for any delay in complying or failure to comply with the T&Cs due to the occurrence of any event or circumstance beyond its control, including without any limitation to, acts of God, natural disasters or catastrophes, extremely severe weather, fire, subsidence, riots, outbreak of military hostilities (whether or not war is declared), expropriation by governmental authorities, act of terrorism, earthquake, flood, embargo, sabotage, explosion, epidemics, health threats, quarantine requirements, COVID-19 restrictions, governmental or regulator act, strike (including that of its own employees and/or contractors), civil commotion, failure of third parties (including Vendors), change or issuance of new applicable laws.
In all circumstances, Strides’ decisions shall be final, binding and conclusive on all matters relating to the event, and no further correspondence shall be entertained. The Participant agrees and undertakes to be bound by the aforesaid decisions.
The T&Cs shall constitute the entire understanding and agreement between Strides and the Participant on the other.
In the event of any inconsistency between the T&Cs and any brochure, marketing, promotional material, FAQs or any other terms and conditions relating to the event, the T&Cs shall prevail.
11 Governing Law
The T&Cs shall be governed by and construed in accordance with the laws of Singapore. Any disputes relating to the T&Cs shall be subject to the exclusive jurisdiction of the courts of Singapore.
